These Conditions apply to all persons entering and making use of the Wanterfeeling Site

Entry and Access

— Entry to the Site will only be authorised upon presentation of a valid ticket, pass, wrist band or accreditation issued by or on behalf of the Wanterfeeling Crew and, if required, photographic proof of identity.

— Ticket holders enter the Site at their own risk.

— All visitors, regardless of age, must have a ticket. For those aged 16 and younger, a free ticket is required along with proof of age.

— Children will be permitted entry with one adult ticket holder. Parents and guardians assume responsibility at all times for minors on the Site who are attending with them.

— The right to culture. Access for 1.50 € to cultural events for Kulturpass card holders. Kulturpass card holders must bring proof as due to license conditions . No presale possible for Kulturpass card holders.

— Access to certain areas of the Site is restricted to authorised persons only and/or may be subject to certain conditions. Non authorised persons must not enter into or make use of restricted areas unless specifically authorised so to do.

— All Attendees must fully comply with the direction of authorised stewards.

— Attendees are not permitted to bring drinks or food into the Event Area. Water is allowed. Baby food is allowed, too.

— Dogs are permitted but must be kept on a leash at all times. Due to the large number of attendees, we strongly recommend not bringing them for their safety and comfort.

— The Wanterfeeling Crew reserves the right to limit items which may be brought to the Site and to search bags and persons before granting entry to the Site or certain areas of the Site. Attendees agree to such searches and the Wanterfeeling Crew reserves the right to refuse entry to, or to eject from the Site, anyone refusing to submit to such a search.

Prohibited Items

— Attendees in possession of Prohibited Items may be refused entry or ejected from the Site. Any Prohibited Items which are surrendered as a condition of entry to the Site shall be deemed to be surrendered irrevocably and voluntarily. Any such items will be unable to be reclaimed and shall be disposed of by the Wanterfeeling Crew without any liability.

— The following items are specifically prohibited from being brought onto the Site or made use of on the Site:

(a) Illegal substances;

(b) Glass bottles or containers or glassware of any kind;

(c) Any item which may be interpreted as a potential weapon and/or compromise public safety, including sharp or pointed objects (e.g. knives, large corkscrews), ‘personal protection’ sprays;

(d) Sound systems;

— Visitors in possession of Prohibited Items may be refused entry or ejected from the Site.

Safety and Security

— Attendees must comply with the instructions of the Wanterfeeling Crew and or its authorised agents (including stewards and security staff).

— Thieves may operate within the Site. Attendees should not leave money or valuables unattended in any area of the Site.

— Security exits will be clearly marked throughout the site. Attendees are encouraged to familiarize themselves with the location of the nearest exit. In the event of an emergency, security guards will guide the crowd. Attendees are instructed to remain calm at all times and follow the directions of security personnel.

— Climbing scaffolding or any permanent or temporary structures, flag poles or trees is strictly prohibited.

Consideration for Others

— Please have consideration for other Attendees.

— Attendees must not use any electronic equipment or amplified sound or musical instruments in a manner that may inconvenience or cause nuisance to others.

— The Wanterfeeling Crew reserves the right to remove and/or deny access to the Site to an Attendee who:
(a) has behaved in a manner which, in the reasonable opinion of the Wanterfeeling Crew has, or is likely to affect the enjoyment of other Attendees; or
(b) uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
(c) in the reasonable opinion of the Wanterfeeling Crew is under the influence of drugs or has consumed an excessive amount of alcohol; or
(d) fails, when required, to produce proof of identity or age; or
(e) obstructs fire lanes, access-ways, exits, entrances or congregates in non-designated areas or seeks entry to areas for which he/she does not hold a wrist band.
(f) is not wearing a valid entry bracelet.

Photography, Filming and Recording

— During the Wanterfeeling various filming, photography and broadcasting takes place on the Site. By attending the Event, Attendees grant their permission, free of charge, for their image, likeness and voice to be included in pictures and/or on film and/or audio broadcasts or transmissions and their exploitation and advertising without compensation or credit. Attendees acknowledge that any such use under this condition, and their agreement to such use, shall last in perpetuity.

— Attendees on the Site acknowledge and agree that the Wanterfeeling is the sole legal and beneficial owner of any intellectual property rights (including copyright) in any images or material taken or recorded at the Site (including by Attendees) and hereby assign any rights they may have in respect of such images, material or recordings to the Wanterfeeling.

— Attendees waive all rights (including moral rights) in any such images, material or recordings. Attendees are entitled to use any images or material taken or recorded at the Site for their personal use but not for any commercial purposes or for the endorsement of any business or product.

— Still photographs, film, videotape or other audio-visual material recorded within the Site may not be sold, used or published commercially in any way whatsoever unless authorised by the Wanterfeeling and may be confiscated by the Wanterfeeling Crew if such usage is suspected.

— The use of photographic equipment must not inconvenience any other person in the Site.

— Other than for private and domestic use, any persons attending the Wanterfeeling shall not record, use or transmit over the internet, radio, television or any other current or future media, any sound, image, recording or description of the Wanterfeeling, the Site or any match (including any results, statistics, information or other data in respect of the match, whether in whole or in part) or to assist any other person(s) conducting such activities. Recording or transmission in any form of moving image.

— Dangerous behaviour, fly pitching or sale of any other goods or other unauthorised trading will result in immediate expulsion from the site.

— No unauthorised recordings of the event. All images and sound recordings remain the property of the Wanterfeeling.

Limitation of Liability

— Wanterfeeling shall not be liable for the loss or damage of vehicles, goods or other materials belonging to attendees, guests, artists and crew attending the Site.

— In no event shall the Wanterfeeling Crew or any of its servants agents or providers be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, or the cost of procurement of substitute goods and services, arising out of or related to the Wanterfeeling whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise other than:

(a) in any circumstances where there is a breach of a legal duty of care owed by the Wanterfeeling; or

(b) in circumstances where such loss or damage is reasonably foreseeable result of any such breach; and

(c) to the extent that any increase in any loss or damage does not arise from breach by You of any of these Terms and Conditions.

— Notwithstanding the above nothing in these Conditions of Entry shall act to, exclude or limit our liability for death or personal injury resulting from our negligence, fraud or any other liability, which may not by applicable law be excluded or limited.

— The Wanterfeeling will not be responsible for any theft, damage or loss to Attendee’s equipment and personal possessions.

WANTERFEELING RESERVES THE RIGHT FOR ITS AUTHORISED EMPLOYEES, AGENTS, CONTRACTORS AND POLICE OFFICERS ACTING REASONABLY TO REMOVE FROM THE SITE (WITHOUT REFUND OR COMPENSATION) ANY PERSON WHO CONTRAVENES THE ABOVE ‘CONDITIONS OF ENTRY AND TERMS OF USE AND ANY PERSON WHOSE PRESENCE AND/OR BEHAVIOUR IN THE SITE COULD REASONABLY BE CONSTRUED AS DANGEROUS, A NUISANCE OR ANNOYANCE TO ANY OTHER PERSON IN THE SITE.

These Terms and Conditions should be read carefully prior to purchase and any queries relating to them should be raised with us prior to purchase, as purchase of Tickets constitutes acceptance of these Terms and Conditions. Entry to and use of the Wanterfeeling Site is subject to the “Conditions of Entry and Site Use” which can be accessed via the Wanterfeeling website.

General

— In these Terms and Conditions “We”, “Our” or “Us” shall refer to the Commune de Sanem and “You” and “Your” shall refer to such person purchasing a Ticket.

— Please note that access to the Wanterfeeling Site is subject to holding a valid ticket and subject to the Conditions of Entry and Site Use which can be found at www.wanterfeeling.lu

— For the purposes here of “Ticket” shall mean a ticket or voucher which entitles the purchaser to acquire a corresponding wrist band at the Wanterfeeling ticket office authorising entry to the Event site corresponding to the Ticket purchased. Wristbands are not transferrable.

— We will not be responsible for any Ticket that is lost, stolen or destroyed. We only accept responsibility for Tickets bought from us. Any queries regarding Tickets purchased from ticket Agents must be directed to the relevant Agent from which the Ticket was purchased.

— It is not always possible to issue duplicate ticket(s). Duplicates may be issued at our discretion.

— Tickets must only be purchased for personal use and not be used for onward sale, advertising, promotions, contests or sweepstakes. Tickets are non-transferable between 8th and 10th November 2024. Wristbands or similar accreditation cannot be transferred. Any wristband that is cut or tampered with will be deemed invalid and will not grant access to the festival on subsequent days.

Price and Refunds

— The price of the Ticket shall be the price set at the time We accept Your order. All advertised prices are inclusive.

— In the event that the Wanterfeeling is not held or cancelled for any reason You will be entitled to claim a refund from Us in accordance with the following provisions.

— The refund for Ticket(s) equals the greater of the price paid by You to Us for such Ticket, or the face value of the tickets.

— Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method as was used to purchase the Tickets. We shall not be responsible for refunds of Tickets purchased through a third party.

— These Terms and Conditions do not and shall not affect your statutory rights as a consumer.

Invalid tickets

— Any Ticket obtained in breach of these Terms and Conditions shall be void and all, rights conferred or evidenced by such Ticket shall be void. The holder shall not be entitled to receive a wrist band entitling entry to the Site.

— Any person seeking to use such a void Ticket in order to gain or provide entry to an Event may be considered to be a trespasser and may be liable to be ejected and liable to legal action. Void Ticket(s) are non-refundable.

— Tickets may be subject to certain restrictions on entry.

— It is Your responsibility to ensure that You read all notifications displayed on Our website.

— No refunds will be given to Ticket holders who are refused entry or ejected due to their own behaviour.

Lost and Found — Information Point

— An information point will be located in front of the castle. This is where attendees can recover lost items and bring found items. In addition, attendees will be able to access site plans, the event timetable, bus information, and more.

Health and safety

— Ticket holders must comply with all relevant statutes, safety announcements and Venue regulations whilst attending the Festival. If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be provided when ordering Tickets. Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.

— The event is held outdoors in a field setting. For your safety and comfort, attendees are strongly advised to wear appropriate clothing and footwear suitable for natural terrain. Please note that due to the nature of the venue, not all areas may be accessible to strollers or wheelchairs. Attendees with mobility concerns are encouraged to contact the event organizers in advance for further information and assistance.

Dispute resolution

— Any complaints about the Festival should be made promptly to the Commune de Sanem.

— If any dispute arises the Wanterfeeling Crew will attempt to resolve it. Although this does not restrict your rights to pursue court proceedings, if we are unable to settle any dispute by negotiation within 21 days, the parties may attempt to settle it by mediation. To, initiate a mediation a party must give written notice to the other parties to the dispute requesting a mediation.

Assignment

—We shall be entitled to assign any of Our rights and obligations under these Terms and Conditions provided that Your rights are not adversely affected.

Third parties

— Any person who is not a party to these Terms and Conditions shall have no rights under the Contracts.

Events beyond our reasonable control (force majeure)

— For the purposes of these Terms and Conditions, ‘Force Majeure’ means any cause beyond Our control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, disease, fire, explosion, flood, theft of essential equipment, malicious damage, pandemic, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments. We will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

Whole agreement

— These Terms and Conditions constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms of Conditions or not) other than as expressly communicated by Us to You before You have completed Your purchase or set out in these Terms and Conditions.
